Terms of Service
By creating an account or using Que Fecha, you agree to these Terms. If you do not agree, do not use the app.
1. What Que Fecha is
Que Fecha is a community marketplace that helps users discover, save, review, and contact independent event vendors. We provide the platform; vendors listed on Que Fecha are independent third parties, not employees or agents of TacoBytes.
2. Eligibility
You must be at least 13 years old to use the app. If you are under 18, you may use the app only with permission from a parent or legal guardian. You are responsible for ensuring your use complies with applicable laws.
3. Accounts
You agree to provide accurate information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access.
4. Listings and user content
You may submit vendor listings, photos, reviews, and other content (“User Content”). You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute it as needed to operate and promote the service.
You represent that:
- You have the right to post the content you submit
- Your listing information is truthful to the best of your knowledge
- Your content does not violate law or third-party rights
Prohibited content includes, without limitation: false or misleading listings; impersonation; hate speech; harassment; illegal services; malware; spam; sexually explicit content involving minors; and content that infringes intellectual property or privacy rights.
5. Moderation
Listings may appear while pending review. We may approve, reject, edit visibility of, or remove any content at our discretion to protect users and the community. Rejected listings may include a reviewer note. We are not obligated to host any particular listing or review.
6. Reviews
Reviews must be honest and based on genuine experience. We may remove reviews that are abusive, fraudulent, off-topic, or otherwise violate these Terms.
7. Vendor relationships and transactions
Que Fecha helps users discover and contact vendors. Unless explicitly stated in the app, we do not process bookings, payments, contracts, or event services on your behalf. Any agreement, payment, or dispute between a user and a vendor is solely between those parties.
8. Acceptable use
You agree not to misuse the app, including by scraping, reverse engineering, interfering with security, creating fake accounts, or using the service for unlawful purposes.
9. Intellectual property
The Que Fecha name, branding, app design, and software are owned by TacoBytes or our licensors and are protected by applicable intellectual property laws. You may not copy or exploit them without permission.
10. Termination
You may stop using the app at any time and may delete your account in Profile settings. We may suspend or terminate access if you violate these Terms or if necessary to protect the service or other users.
11. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY OF LISTINGS, AVAILABILITY OF VENDORS, OR OUTCOMES OF EVENTS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TACOBYTES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR INTERACTIONS WITH VENDORS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY).
13. Indemnity
You agree to defend and indemnify TacoBytes against claims arising from your User Content, your use of the app, or your violation of these Terms or applicable law.
14. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in California, unless applicable law requires otherwise.
15. Changes
We may update these Terms from time to time. We will revise the effective date above when we do. Material changes may also be communicated in the app. Continued use after changes means you accept the updated Terms.
